California Sues Trump Administration Over Tariffs, Citing Overreach

The state of California has filed a lawsuit against the Trump administration, challenging the president’s authority to impose sweeping retaliatory tariffs and arguing that such actions violate the U.S. Constitution.

In a federal complaint filed on April 16, California officials contend that President Donald Trump overstepped his authority by using the International Emergency Economic Powers Act (IEEPA) to justify tariffs on imported goods. They argue that the law does not grant the president the power to set trade duties.

“We’re asking the court to rein in the president and defend the Constitution,” said California Attorney General Rob Bonta. “Once again, the president is acting as if he’s above the law—he’s not.”

Bonta emphasized that the power to levy tariffs rests with Congress, not the executive branch, and said California is taking legal action to reverse Trump’s decision. “He simply does not have the authority, and we intend to stop him,” he said.

California Governor Gavin Newsom also weighed in, calling the move “one of the most reckless own goals in our nation’s history.”

The lawsuit marks the most significant legal challenge yet to Trump’s tariff policies, which have rattled global markets and triggered backlash from American industries. With nearly 40 million residents, California is the most populous U.S. state, accounting for 14% of national GDP and ranking as the world’s fifth-largest economy on its own. Officials warn that California could bear the brunt of the economic fallout.

Newsom’s office estimates the state could lose billions in revenue if international trade declines as a result of the tariffs. “This will hurt a lot of people—including voters who supported the president,” Newsom said. “How can we just sit back and let that happen?”

The White House has not yet commented on the lawsuit.

President Trump has long defended tariffs as a necessary tool to rebalance America’s trade relationships. On April 2, he announced new import tariffs on more than 180 trading partners, ranging from 10% to 50%.

Under the initial rollout, roughly 60 countries were set to face elevated tariffs above the base 10% rate starting April 9. However, Trump later paused most of the increases for 90 days—except for China—to allow time for further negotiations.
