Five U.S. Businesses Sue Trump Administration Over Tariffs
The Liberty Justice Center (LJC) has filed a lawsuit on behalf of five American companies, accusing the Trump administration of overstepping its authority on trade policy.
In a complaint submitted to the U.S. Court of International Trade on April 14, the Chicago-based legal group — affiliated with the Illinois Policy Institute — argued that President Donald Trump’s sweeping tariffs on U.S. trade partners go beyond the powers granted to the executive branch.
“No single individual should have the authority to impose tariffs with such far-reaching economic consequences,” said Jeffrey Schwab, senior counsel at LJC. “Under the U.S. Constitution, the power to set tariffs — including those related to trade — belongs to Congress, not the president.”
The lawsuit seeks to block the administration’s broad tariff measures. LJC is representing five American import-export businesses involved in distributing wine, electronics, fishing gear, plastic piping, and apparel.
The White House has not yet commented on the case.
This legal challenge comes amid another lawsuit pending in a Florida federal court, where a small business owner is also seeking to halt tariffs imposed by the Trump administration on Chinese goods.
The Liberty Justice Center is no stranger to high-profile litigation. It previously played a key role in Janus v. AFSCME, a landmark Supreme Court case that significantly curtailed public sector unions’ collective bargaining power.
